Governor Signs Bill Extending Eviction Notice Period After Foreclosure

On July 8, 2008, Governor Schwarzenegger has signed SB 1137.  The measure passed the Senate on July 2, 2008 with a bipartisan vote of 32-8.  In
addition to providing protections for homeowners caught in the mortgage
crisis, the measure protects tenants by increasing the eviction notice
period from 30 to 60 days in certain foreclosure situations.  The law applies where tenants are not otherwise protection from eviction by local eviction controls. 

The law does not apply "if any party to the note [ie, mortgage] remains in the property as a tenant, subtenant, or occupant."

The law sunsets January 1, 2013.
