Under these discimination protections, landlords must provide reasonable accomidations<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Family Status<\/li>\n\n\n\n<li>Age<\/li>\n\n\n\n<li>Association with these groups\n<ul class=\"wp-block-list\">\n<li>(this includes if landlords \u00abperceive\u00bb a tenant as being within these groups, or \u00abassociating\u00bb with persons in these groups)<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Common behaviors that may be considered as discrimination<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Inconsistent questions or evaluation of tenant rent applications<\/li>\n\n\n\n<li>Refusing to rent on the basis of above listed characteristics of a tenant<\/li>\n\n\n\n<li>Indication of preference or unequal treatment of tenants<\/li>\n\n\n\n<li>Harassment&nbsp;<\/li>\n\n\n\n<li>Retaliation<\/li>\n\n\n\n<li>Access barriers&nbsp;<\/li>\n\n\n\n<li>Failure to provide reasonable accommodate of a disability<\/li>\n\n\n\n<li>Deny renting to a tenant on precieved and stereotyped threats&nbsp;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Landlords can ONLY exclude renting to a tenant on the basis of\u2026&nbsp;<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Poor credit history<\/li>\n\n\n\n<li>Credit references that don&#8217;t check out<\/li>\n\n\n\n<li>History of tenant activity like not paying rent, or illegal use of the property&nbsp;<\/li>\n\n\n\n<li>Families that exceed persons-to-space ratio<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Where do these protections come from?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Federal Fair Housing Act 1968, Department Fair Employment and Housing Act Government Code 1290, and the Unruh Act (Civil Code 51 and 54)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">What actions can I take as a tenant to put a stop to discrimination against me or my neighbors?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Send a demand letter to your landlord to stop discriminatory behavior or harassment. Tenants Together has created a&nbsp;<a href=\"https:\/\/tenantstogether.org\/sample-letter\/harassment\/\" data-type=\"sample-letter\" data-id=\"2715\" target=\"_blank\" rel=\"noreferrer noopener\">Harassment Sample Letter<\/a>&nbsp;in order to make these requests to your landlord.<br>&nbsp;<\/li>\n\n\n\n<li>File an administrative complaint:\n<ul class=\"wp-block-list\">\n<li>On the state level: to the California Department of Fair Employment and Housing (DFEH)\n<ul class=\"wp-block-list\">\n<li>800-884-1684 or&nbsp;<a href=\"http:\/\/www.dfeh.ca.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">www.dfeh.ca.gov<\/a>\n<ul class=\"wp-block-list\">\n<li>Tenants can file a complaint form within 1 year after the act of discrimination<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>On the federal level: to the U.S. Department of Housing and Urban Development (HUD) related to discrimination on the basis or race, religion, national origin, sex, family status, or disability\n<ul class=\"wp-block-list\">\n<li>Go to&nbsp;<a href=\"http:\/\/www.hud.gov\/\" target=\"_blank\" rel=\"noreferrer noopener\">www.hud.gov<\/a>, go to topic areas, and search for housing discrimination&nbsp;<\/li>\n\n\n\n<li>800-347-3739\n<ul class=\"wp-block-list\">\n<li>Tenants can file a complaint form within 1 year after the act of discrimination<br>&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Sue the discriminating landlord\n<ul class=\"wp-block-list\">\n<li>Review guide&nbsp;<a href=\"https:\/\/www.disabilityrightsca.org\/publications\/housing-discrimination-based-on-disability-your-rights-and-options#:~:text=If%20a%20landlord%2C%20homeowners%20association,can%20take%20a%20long%20time.\" target=\"_blank\" rel=\"noreferrer noopener\">\u00abHow to Sue if a Business or Landlord Discriminates Against You Because of Your Disability\u00bb<\/a>&nbsp;created by Disability Rights California&nbsp;<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Reasonable Accommodations<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">What rights do I have to request reasonable accommodations?<\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any person with a disability may file a request with their landlord for reasonable accommodation to use and enjoy their rental unit.\n<ul class=\"wp-block-list\">\n<li>A disability is considered any physical or mental impairment or condition that limits a major life activity.<\/li>\n\n\n\n<li>The disability also doesn&#8217;t have to be permanent.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It is ALWAYS okay to ask for accommodations\n<ul class=\"wp-block-list\">\n<li>It is ILLEGAL for landlords to punish or evict a tenant for requesting reasonable accommodations or modifications. The disability also doesn&#8217;t have to be permanent.&nbsp;The only basis in which landlords can flat-out deny a request is if it seriously impacts the landlord&#8217;s ability to do business.<\/li>\n\n\n\n<li>If you feel that you have been retaliated against for requesting reasonable accommodations, fill out our&nbsp;<a href=\"https:\/\/tenantstogether.org\/sample-letter\/retaliation\/\" data-type=\"sample-letter\" data-id=\"2712\" target=\"_blank\" rel=\"noreferrer noopener\">Retaliation Sample Letter<\/a>&nbsp;with your situation and provide it to your landlord as soon as possible.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The only basis which landlords can flat-out deny a request is if it seriously impacts the landlord&#8217;s ability to do business.<\/li>\n\n\n\n<li>Tenants must pay for physical modifications for their requested accommodation, unless in specific instances when the landlord receives some type of federal financial assistance.<\/li>\n\n\n\n<li>Landlords may also require that the unit be restored to its original condition at the end of tenancy.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Process for Requesting Reasonable Accommodation&nbsp;<\/h3>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Write a written request to the landlord.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Within this request, a tenant must provide documentation of the disability and disability-related needs (such as a letter from a doctor or therapist).<\/li>\n\n\n\n<li>However, a landlord cannot ask a tenant to prove their disability or insist on unreasonable amounts of proof.<\/li>\n\n\n\n<li>Tenants Together has created a&nbsp;<a href=\"https:\/\/tenantstogether.org\/sample-letter\/requesting-reasonable-accommodations-for-a-disability\/\" data-type=\"sample-letter\" data-id=\"2721\" target=\"_blank\" rel=\"noreferrer noopener\">Reasonable Accommodations Request Sample Letter<\/a>&nbsp;that can be used to make these requests to a landlord. Tenants should send letters to landlord via certified mail.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Landlord must respond quickly to engage in an \u00abinteractive process\u00bb<\/strong>.
