Rent Stabilization
Exemptions
SFH and condos per Costa Hawkins Act. Anything built after 2/1/1995. Duplexes, “companion units” and government owned and assisted apartments, per local law.
How much can rent be increased and how often?
2023 AGA: 5.0% (Sept. 1, 2023 – Aug. 31, 2024); At least 12 months has to have passed since the last rent increase and the overall Rent increase in any twelve-month period shall not exceed ten percent (10%) of the Rent actually charged to the Tenant
Is banking allowed?
Yes, but with a 10% cap
Are passthroughs or additional costs allowed (pets, utilities, parking, etc)?
Landlords can petition for maintenance of operating income or capital improvement increases

Under what circumstances is the landlord obligated to pay relocation assistance to tenant?
No fault just causes and terminations based on Necessary and Substantial Repairs Requiring Temporary Vacancy. Relocation Assistance is not available to those whose household income exceeds 120% of the median household income for Santa Clara County.
