Rent Stabilization

Exemptions

SFH and condos per Costa Hawkins Act. Anything built after 7/1/1979. ADUs, units subsidized by any govt agency, and nonprofit coops per local law, mobile homes.

How much can rent be increased and how often?

No more than 5% in a 12-month period

Is banking allowed?

Banking allowed: The total rent increase (annual increase plus the banked rent increase) may be 10% or less of the tenant’s current rent. Banked rent increases expire after 10 years.

Are passthroughs or additional costs allowed (pets, utilities, parking, etc)?

Landlords can submit a fair return or capital improvement petition, which is then arbitrated with tenant.

Under what circumstances is the landlord obligated to pay relocation assistance to tenant?
