Rent Stabilization

Exemptions

SFH and condos per Costa Hawkins Act. Townhomes per local law. Units subsidized by any govt agency with the exception of Sec 8 which IS covered. Deed-restricted affordable housing. Units that the landlord or the landlord’s immediate family occupies as long as they remain in occupancy.

How much can rent be increased and how often?

4% or the change in CPI, whichever is less.

Only one rent increase per 12 months.

Are passthroughs or additional costs allowed (pets, utilities, parking, etc)?

Landlord can apply to pass through 50% of Capital Improvement costs amortized over a minimum of 5 years; Landlord can submit Rent Adjustment Application, petitioning fair rate of return.

Under what circumstances is the landlord obligated to pay relocation assistance to tenant?

All no-fault just cause evictions in qualifying units are entitled to 3 months of the tenant’s monthly rent as relocation assistance. Qualifed tenants are entitled to an additional month of the tenant’s current rent.
